Federal Complaint Filed Against Jared Lee Loughner
He is being charged with the the murder of Judge John Roll and Giffords staffer Gabriel Zimmerman, as well as the shooting of Gifford and her staffers Ron Barber and Pamela Simon. The complaint says that they were all “engaged in performance of official duties” at the time.
It’s not clear what charges will be filed in the other shootings, but that may be reserved for state jurisdiction.

Per David Nakamura of the Washington Post, Loughner appears in court in a khaki jumpsuit, in handcuffs with chains around his waist and legs. The judge calls for him to be held without bail and calls him a “danger to society.”
CNN says that Loughner spoke a lot during the proceedings. He appeared competent and apparently understood the charges as the judge went through them.
Judge is Lawrence Anderson, who listed the potential sentences, including the death penalty for the two murders.
No members of Loughner’s family were present during the proceedings.
There will be a preliminary hearing at 1:30 PM on January 24.
The judge mentioned that none of the judges in the Tucson wanted the case, and have recused themselves. At that preliminary hearing, he will not be the judge.
There will not be an Arizona judge in the upcoming hearing. They will bring in another judge from somewhere else in the country.
Judith Clark was given temporary permission to represent Loughner. She defended the Unabomber, Zacharia Moussaoui and Timothy McVeigh. The defender’s office recommended her for the case because of concern that Arizona lawyers may also face perceived conflicts. The Wall Street Journal reports that they have also recommended attorneys Mark Flemming and Reuben Cahn be appointed to the case.
