…with the judge promising to read the colcord case before the end of this trial, the courtroom chuckling at that comment, the defense attorneys wanting to be sure the plaintiff attorneys stayed at least 3 feet away from the jurors, and then another round of giggles from that query, the day was off and running in the trial i’m observing, seiu-uhw vs. rosselli, et al…fyi, one of the defendants is nuhw itself…

…first up, our finance guy, edgard cajina, returned to the stand…he testified that the 200 blackberrys and the 100 pre-paid phones were paid for from the pef, the patient education fund…you know that fund, it’s where the 3 million dollars went…these 300 phones were for staff, e-board members and chosen activists in case of trusteeship…he spoke about going with defendant phyllis willett to see the newwho? office in the california nurse’s association headquarters a few blocks away from the oakland office…edgard then suffered through defendants attorney questions, questions I considered totally irrelevant and demeaning about his country of origin and accounting skills…

…witness # 21, abby reeve, took the stand next…she tied gail buhler and barbara lewis, and brian mcnamara (not a defendant) to more of the activities that have landed this motley crew in court…she also spoke about her work time being 70% to form newwho? and only 30% representing members due to the directives she received from the three musketeers named above…now you know why your grievance was gathering dust last year…

…next, the managing director of the chicago office of capstone evaluation services,
michael lasinski, a cpa, told us about his findings of how much we had paid the defendants, sal, et al, in salary and benefits, to work for us in january of last year while actually they were out gallivanting around the countryside attempting to form nuhw instead…again, the defense tried to belittle the witness, “just bookkeeping,” but michael was too quick for them and zinged back, “yes, that’s what 10% does.”…

…#23…witness annie durazo testified…secret meeting…gabe kristal… disaffiliation…10% vs. 90%, rep work vs. newwho? petition gathering…john vellardita…phone tree…prepare for trusteeship…I think by now you’re getting the picture of what was going on in our union in our names…

…someone I have known for many years testified next…uhw operations coordinator, lynn Templeton, over & over & over tied phyllis willet to uniongate…lynn whited out joan emslie’s name on the phone contract, she paid for the phones with money from the patient ed fund, ordered cell phone cases and ear buds (pef paid, again), went to the homes of dan martin and ralph cornejo to set up and program their new phone systems, signed a dozen or so letters to vendors to deny seiu access, and all these activities she was directed to do by phyllis willett…

…alex espinoza, rep/organizer with hca hospitals we represent, testified about his interactions with defendants buhler and lewis, again showing these rosselli lieutenants getting involved in activites that have ended them up in court…questioned & charted as a “1” by barbara lewis in a phone call, he quickly fell out of favor…

…yvonne shaw was up next…gee, vellardita’s name is all over the place…he was in her testimony, also…did you know, according to yvonne’s testimony, the members did not get to vote on their contract extension being cancelled?…she spoke about shredding and boxes being packed…yvonne was asked to keep her job and spy on her co-workers for newwho?…

…witness #27 and the biggest new news of the day was by phillip rodokanakis, an expert witness and certified examiner of computers for trials…he found back up files in computer belonging to defendant fred seavey…one file dated 1-21-09 was titled nuhw staff…no can do, fred…he found 5700 double-deleted emails on john borsos’ computer…makes one wonder, does it not?…
